1. Acceptance of terms

By accessing and using bloodniobium.org or any other language version of this platform (br.bloodniobium.org — Portuguese; zh.bloodniobium.org — Mandarin), you agree to these Terms of Use and to the Privacy Policy. If you do not agree with any provision, please do not use this site.

2. Nature and purpose of the platform

Blood Niobium is a platform of an informational, investigative journalistic, and global advocacy nature, dedicated to:

  • Documenting and disseminating allegations of human rights violations related to CMOC International's (HKEX: 3993) operations in Brazil;
  • Informing global stakeholders — investors, auditors, regulators, ESG certification bodies, governments, and civil society — about the financial, regulatory, and reputational risks arising from the documented violations;
  • Facilitating coordinated action by citizens, professionals, and institutions committed to corporate accountability and human rights;
  • Preserving and disseminating the case of Glória Duarte and the other co-owners of the Boa Vista Mine lands, Catalão/GO, Brazil;
  • Distributing two specialised Documentary Guides (Guide to Normative Violations and Risk Guide by Stakeholder Profile), structured for 9 stakeholder profiles and organised under the 3-Tier Documentary Admissibility System (Tier 01 Open, Tier 02 Verified, Tier 03 Counsel-grade);
  • Making available 6 structured Action Channels — including Canal 06 Strategic Notifications by Profile, pre-written for regulatory bodies, auditors, governments and press across multiple jurisdictions.
All published content is based on documents, court records, public financial statements, evidence, and verifiable accounts. This site has no commercial purpose and does not represent any corporate entity.

3. Intellectual property

All content on this platform — including texts, dossiers, analyses, images, graphics, layout, and design — is the exclusive property of its authors and is protected under Brazilian copyright law (Law No. 9,610/1998) and applicable international treaties.

  • Partial reproduction is permitted for journalistic, academic, advocacy, or educational purposes, provided the source is cited ("Blood Niobium — bloodniobium.org") and the original context is maintained;
  • Full or commercial reproduction is prohibited without prior written authorisation;
  • Use of content in a way that distorts, decontextualises, or subverts the published information is prohibited;
  • The open letter by Glória Duarte is authored by and the property of Ms. Glória Duarte; its reproduction is permitted only for advocacy purposes and with attribution of authorship.

The information published on this platform reflects documented facts, technical analyses, and the authors' perspective based on verifiable sources. All content follows the 5-Layer Methodology + 3-Tier System described on the About Us page. While every effort is made to ensure accuracy and currency:

Messages with offensive, threatening, or inappropriate content will be disregarded and may be reported to competent authorities. All contacts are logged as part of the Blood Niobium case protocol.

7. Support Manifesto and advocacy actions

The platform provides civic participation mechanisms, including:

  • Support Manifesto: by signing, the user expressly authorises the inclusion of their name and country in the public advocacy document, forwarded to the CMOC Board, Deloitte, ESG agencies, and other bodies of interest. Consent is collected at the point of signing and may be revoked at any time;
  • Pre-written communication templates: the emails, letters, and notifications provided on the platform are model communications. The user assumes full responsibility for sending them and for any personalised content added;
  • Strategic suggestions: registered in the case's internal protocol and treated as voluntary contributions, without generating any contractual or remuneration relationship.

8. Right of Reply

Blood Niobium maintains a permanently open Right of Reply channel for CMOC Group Limited, its legal representatives, directors, auditors (Deloitte), and any other cited party who wishes to contest, correct, or clarify information published on the platform.

Official statements submitted through this channel:

  • Will be published in full on the platform, without content editing, subject to minimum language standards;
  • Must include the full identity of the sender and the entity they represent;
  • Will receive a response from the Blood Niobium team within 5 business days of receipt;
  • Do not constitute a waiver of any rights of the parties involved in the litigation.

9. Public interest and press freedom declaration

This platform operates within investigative journalism in the public interest and human rights advocacy. The Blood Niobium case involves a publicly listed company (HKEX: 3993) with public disclosure obligations, ESG certifications issued by international bodies, and impact on global supply chains. The disclosure of the information herein is therefore of legitimate public interest, as recognised by international press freedom standards and the UN Guiding Principles on Business and Human Rights (UNGPs).

The exercise of freedom of expression and the press, protected by the Brazilian Federal Constitution (Arts. 5(IV), 5(IX) and 220) and applicable international human rights treaties, underpins the publication and maintenance of this platform.

10. Operational limitations — independence statement

Glória Duarte, responsible for the platform and an active party in the litigation against CMOC Brasil Ltda., operates under procedural constraints arising from her position as a litigant. Blood Niobium was structured to function with editorial and documentary independence, regardless of the progress of the judicial proceedings.

The platform is financially independent: it does not receive funding from CMOC, its competitors, investment funds, governments or entities with a direct interest in the litigation. The dossier is maintained with the personal resources of Glória Duarte and the contributing team. Any legal or extrajudicial actions against the platform will be treated as information of public interest and documented within the dossier itself.

11. Governing law, jurisdiction, and international reach

These Terms of Use are governed by the laws of Brazil. The courts of the district of Catalão/GO, Brazil, have jurisdiction over any disputes arising from this instrument.

For users located outside Brazil:

  • Accessing and using the platform implies acceptance of Brazilian law as applicable;
  • Disputes involving users from other countries will preferably be handled through mediation before resorting to judicial proceedings;
  • For data protection matters involving European users, the GDPR applies as a complementary standard, as detailed in the Privacy Policy.

12. Changes

We reserve the right to update these Terms at any time, without prior notice, to reflect operational, legal, or regulatory changes. The current version, with the date of last revision, will always be available on this page.
